Prior Encumbrance

These are all the entries in the land register that precede the bank. The bank always wants to be in the 1st rank position. A prior encumbrance would be, for example, another loan or a right of abode. Usually, these must agree to a so-called rank demotion to make way for the bank. A prior encumbrance reduces the value of the property from the bank's perspective.
